General Terms
The activity of Império Numis is subject to the specified conditions, which regulate the contractual relationship with users (buyers and sellers).
Part I – Object and Definitions
Article 1 (Object)
Império Numis provides an online auction commercial platform where registered users can buy and sell collectible items.
Article 2 (Definitions)
In the contractual relationship between Império Numis and platform users (buyers and sellers), the following terms have the presented meanings:
i) “Auction” – the sale of a lot to the user who submits the highest bid within the specified deadline; ii) “Lot” – a collectible item or set of items, duly numbered, described, and illustrated with images representing it as accurately as possible; iii) “Bidder” – a registered platform user who submits a bid for a specific lot; iv) “Bid” – the act of submitting an offer for a specific lot by a registered user on the platform; v) “Buyer” – the user who submitted the highest bid for a specific lot; vi) “Seller” – the user who sells a lot at auction through the platform provided by Império Numis; vii) “Base Price” – the minimum price established and accepted by the Seller, according to these Terms and Conditions, for the sale of the lot; viii) “Final Price” – the value of the highest bid submitted by a user to purchase a specific lot, excluding commissions and other applicable expenses; ix) “Reserve Price” – a confidential value determined by the Seller below which the lot will not be sold; x) “Sale Commission” – a commission applied, on the Final Price, by Império Numis to the Seller of the lot; xi) “Purchase Commission” – a commission applied, on the Final Price, by Império Numis to the buyer of the lot; xii) “Expenses” – the amount related to the packaging and shipping costs of the lot (which is previously established and disclosed by the Seller, added to the Final Price of the lot), including the applicable VAT amount for the sale of any lot.
Part II – Buyer Terms
Article 3 (Buyer)
The Buyer is an individual (of legal age) or a legal entity duly registered on the online auction platform Império Numis.
The registration on the platform requires filling out a form, providing the following information: full name, address, identification card number, taxpayer identification number, phone number, email address, and confirmation of acceptance of the terms and conditions of Império Numis auctions. Only after the validation of this information by Império Numis will the user’s registration be considered valid, and a confirmation email will be sent to the user.
Following the validation of the user’s registration, a registration number will be assigned, which will identify the user on the platform when placing bids, ensuring their anonymity.
In case of non-compliance with the terms and conditions of use, Império Numis may temporarily or permanently suspend the user’s registration.
Article 4 (Bids)
Bids for lots are made through Império Numis, with prior access by the user using the credentials assigned to them, or through other platforms officially partnered with Império Numis.
Bids have a minimum increment of 1 (one) Euro, and fractional bids are not accepted.
It is expressly prohibited for the Seller of a lot to bid on it.
Article 5 (Payments)
The Buyer undertakes to pay for the lot won by the Final Price, plus the Purchase Commission plus VAT, and the cost of packaging and shipping.
The Purchase Commission is 16% on the Final Price of the lot, plus the legally applicable VAT.
The packaging and shipping cost is disclosed by the Seller and is mandatory in the lot description.
Payment must be made within a maximum period of 5 (five) days from the auction closing date, using one of the means made available by Império Numis. After this period, if payment is not made, Império Numis will apply the current default interest rate, plus a storage commission of 5 (five) Euros per day. After 15 (fifteen) days from the auction closing date, if payment is not made, Império Numis will initiate legal proceedings for contractual non-compliance, reserving the right to temporarily or permanently suspend the defaulting user.
Article 6 (Shipping)
Only after the lot value is collected, Império Numis will instruct the Seller to package and ship the lot, under conditions previously disclosed in its description.
By accepting these Terms and Conditions, the Buyer expressly authorizes Império Numis to share their name and address with the Seller.
The Buyer is responsible for providing the correct and complete address.
Império Numis is not responsible for shipping lots to buyers (except for lots directly sold by this entity), and assumes no responsibility for damages, theft, or loss of the items. The responsibility for the transportation service follows the conditions established between the Buyer and the Seller, based on the conditions previously disclosed by the Seller in the lot description.
Part III – Seller Terms
Article 7 (Seller)
The Seller is the owner of the items that make up the lots placed for auction.
Império Numis provides an intermediary service between the Seller and the Buyer, in the form of auctions.
This service is formalized through a contract that establishes the conditions for its provision.
It is the exclusive responsibility of Império Numis to determine the auction in which the lot will be bid, and this decision will follow, among other criteria, the need to adjust the number of lots in the auction and the need to ensure that lots with similar items are not bid on in the same auction.
In case of suspected fraud, inaccuracies in the lot description, or any other situation that may harm the Buyer, Império Numis may suspend the lot, without any right to compensation to the Seller.
If the same lot does not receive any bids in 3 (three) consecutive or interpolated auctions, Império Numis may reject its admission to a new auction.
Article 8 (Lot Descriptions)
The responsibility for lot descriptions lies exclusively with Império Numis, which must ensure their accuracy and precision.
Lot descriptions should include the following information: lot designation, year, condition, number, and indication of the respective reference catalog (if applicable), conditions, and value of shipping for the lot.
If the item has any defects, and without prejudice to it being visible in the images, this defect will be described as accurately as possible.
As part of the procedures for admitting lots to auction, Império Numis reserves the right to request changes from the Seller to better describe the lot, and may not accept lots if it deems that the description is not accurate or rigorous.
Império Numis may reject the admission of lots to auction if it considers that they do not have the necessary quality or if the expected sale value is lower than the value of the Purchase Commission.
Article 9 (Advertisement of Lots)
The Seller authorizes Império Numis to advertise lots (including images and descriptions) through the means and platforms that this entity deems most appropriate to ensure the dissemination of auctions and the capture of the interest of potential buyers.
Article 10 (Payments)
In case of default by the Buyer, the Seller cannot demand any amount from Império Numis.
Nevertheless, in case of default, after 15 (fifteen) days from the auction closing date, Império Numis will inform the Seller of this situation. Together (Seller and Império Numis), actions will be outlined to ensure the collection of the outstanding amount.
Article 11 (Shipping)
The shipment of the lot to the Buyer is the exclusive responsibility of the Seller, with the authorization of Império Numis after the due amount is collected.
The Seller undertakes to send the lot to the Buyer within a maximum period of 3 (three) business days from the date of communication of shipping authorization by Império Numis.
Part IV – Final Provisions
Article 12 (Final Provisions)
The terms under which Império Numis collects, uses, and processes user data and information are explicitly explained in our Privacy Policy, which complies with national legislation and the General Data Protection Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, applicable.
